1) The children involved in second-parent adoptions do not have to be the biological offspring of one partner. Many adoptions (international and domestic) by same-sex couples are done via two separate adoption processes--the initial adoption by one partner, and the second-parent adoption by the other.
2) It might seem like a small distinction, but when the adoption(s) is/are complete, both partners will be legal parents.
